Telejustice addresses a different problem and not backlog of cases.

There is the fallacy of FALSE CAUSE in this argument which can be attributed to the plan by the Judiciary to introduce ‘Telejustice’:

The absence of telejustice causes the backlog of cases.

Therefore we should intoduce telejustice.

My argument:

It is the nature of the case and not the absence of telejustice that that causes backlog

Therefore,we should not introduce telejustice to address backlog.

‘Telejustice’ may not reduce the backlog of cases in Kenyan courts because what causes the aforementioned problem is not the absence of telejustice but rather the unpredictable nature of cases.It is how the case proceeds that determines whether justice will be delivered faster or not.

Is it not adjournments,fixing of mentioning or hearing dates that cause delayed justice?Surely,how does telejustice expedite justice?They should talk about modernizing the justice system through telejustice ;not reducing backlog of cases through telejustice.
